Text-Message Terms of Service and Conditions

Effective Date: March 5, 2026

Luxury Auto Carriers LLC, doing business as Luxury Auto Transport (“Luxury Auto Transport,” “we,” “us,” or “our”), offers recurring and one-time text messaging programs, which may include marketing messages (collectively, the “Text Programs”). These Text Messaging Terms & Conditions (“Text Terms”) govern your participation in the Text Programs unless we provide additional terms for a specific program.

By opting in to or participating in any Text Program, you agree to these Text Terms, our Terms of Service, and our Privacy Policy, each of which is incorporated by reference and made part of these Text Terms. If there is a conflict between these Text Terms and any other policy that applies specifically to text messaging, these Text Terms control for the Text Programs.


1) Definitions

For purposes of these Text Terms:

  • “Text Program(s)” means any SMS, MMS, or RCS messaging program offered by Luxury Auto Transport, including recurring and one-time messages.

  • “Message(s)” means any text message, multimedia message, rich communication message, or similar communication sent through a Text Program.

  • “You” means the person enrolling a phone number and/or the person using a device associated with that phone number.


2) Eligibility, Authority, and Accurate Information

You may enroll only if you:

  • are 18 years of age or older, and

  • are the mobile account holder for the number you enroll (or have the account holder’s authorization).

You represent and warrant that:

  • the number you provide is accurate and is associated with you (or you are authorized to enroll it),

  • you will not enroll a number you do not control, and

  • you will promptly notify us if your phone number changes or is reassigned to someone else.


3) Consent to Receive Messages; No Condition of Purchase

By providing your mobile number and completing the opt-in process, you provide express consent to receive Messages from Luxury Auto Transport at that number, which may include transactional, informational, customer support, and/or marketing messages, depending on the program.

Messages may be sent using an automatic telephone dialing system and/or artificial or pre-recorded voice, where permitted by law.

Consent is not a condition of purchase. You can buy goods or services from Luxury Auto Transport even if you do not opt in.


4) Program Description; Frequency; Delivery Not Guaranteed

Text Programs may include Messages such as:

  • quote confirmations and follow-ups,

  • scheduling, pickup, and delivery updates,

  • customer support communications,

  • service announcements, and

  • promotional offers (if you opted into marketing).

Messages may be delivered via SMS, MMS, or RCS. Message frequency may vary, and we may change frequency at any time (including increasing or decreasing the number of Messages we send).

Delivery is not guaranteed. Messages may be delayed, not delivered, duplicated, or received out of order due to factors outside our control, including carrier/network conditions, device limitations, and coverage constraints.

Text Programs are not for emergencies. Do not use Text Programs to send or receive emergency communications. If you have an emergency, call 911.


5) Costs; Message and Data Rates

Message and data rates may apply based on your carrier and plan. You are solely responsible for all charges billed by your wireless provider, including charges related to receiving Messages.


6) How to Opt In; Confirmation

You may opt in by following instructions we provide, which may include:

  • texting a keyword to a phone number or short code,

  • entering your phone number on our website, or

  • providing consent through another method we make available.

We may send a confirmation Message and/or require a confirmation reply (for example, replying Y or another designated response) before enrollment is completed.


7) How to Opt Out; Universal Keywords

You can opt out of a specific Text Program at any time by replying STOP to the number or short code from which you received Messages.

You may also opt out using standard keywords such as END, CANCEL, UNSUBSCRIBE, or QUIT. After opting out, you may receive one final confirmation Message acknowledging your opt-out.

Opting out of one Text Program may not opt you out of all programs if you enrolled through different numbers/short codes or separate opt-in flows.

9) Number Changes; Reassigned Numbers; Your Responsibility

If your mobile number changes, is disconnected, or is reassigned, you agree to notify us promptly. You understand that if you fail to do so, Messages intended for you may be delivered to a new subscriber of that number.

You agree that any opt-out request submitted from a phone number will be treated as an opt-out by the user of that number.


10) Carriers, Devices, and Technical Limitations

Carrier participation varies. Not all carriers or devices support all message types (including MMS or RCS), and Messages may not be deliverable in all areas. Wireless carriers are not liable for delayed or undelivered Messages.

We are not responsible for:

  • carrier filtering or blocking,

  • device incompatibility,

  • network outages or degradation,

  • user settings that prevent receipt (including “Do Not Disturb” or spam filtering), or

  • any third-party app behavior that affects delivery or display.


11) Privacy; Security; Third-Party Service Providers

We may use vendors and service providers to operate the Text Programs (including delivery platforms, routing partners, and customer support tools). We may share your information with those providers only as necessary to send Messages, provide support, prevent fraud/abuse, and operate the Text Programs, consistent with our Privacy Policy.

Text Messages may not be encrypted and may be accessed by others who have access to your device or wireless account. You are responsible for securing your device, login credentials, and Message inbox.

No transfer for third-party marketing. Your opt-in consent is for Luxury Auto Transport’s communications and is not a permission for third parties to market to you.


12) Acceptable Use; Fraud and Abuse Prevention

You agree not to:

  • enroll numbers without authorization,

  • attempt to bypass opt-out mechanisms,

  • use the Text Programs to submit unlawful, abusive, or fraudulent requests,

  • interfere with program operations, or

  • use any automated means to interact with the Text Programs in a manner that imposes an unreasonable burden.

We may suspend or terminate your participation, block numbers, or restrict access to any Text Program if we reasonably believe it is necessary to prevent fraud, abuse, consumer harm, operational disruption, or legal non-compliance.


13) Links; Phishing; No Endorsement

Messages may contain links or instructions. Always verify that a Message is from Luxury Auto Transport before providing information. We are not responsible for third-party websites or content accessible via links, and linking does not imply endorsement.


14) Program Changes; Modification; Discontinuation

We may modify, suspend, or discontinue any Text Program at any time, including changing the sending number, short code, or messaging method, to the extent permitted by law. Where required, we will provide notice.

We may also update these Text Terms at any time. Updates are effective when posted on our website. Your continued participation after posting constitutes acceptance of the updated Text Terms.


15) Disclaimers

THE TEXT PROGRAMS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, LUXURY AUTO TRANSPORT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, NON-INFRINGEMENT, AVAILABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.

We do not warrant that Messages will be delivered, timely, secure, or error-free.


16) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LUXURY AUTO TRANSPORT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE TEXT PROGRAMS OR THESE TEXT TERMS, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Without limiting the foregoing, we are not liable for damages arising from delayed, failed, misdirected, incomplete, intercepted, or out-of-order Messages; carrier/network failures; device incompatibility; or unauthorized access to your device or Messages.

Any additional limitations of liability in our Terms of Service apply and control.


17) Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Luxury Auto Transport and its affiliates, officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

  • your enrollment in or use of any Text Program,

  • your violation of these Text Terms or applicable law,

  • your failure to obtain authorization to enroll a phone number, or

  • any claim that Messages were sent to a number you provided without valid consent.


18) Dispute Resolution; Arbitration; Class Action Waiver

Disputes arising out of or relating to these Text Terms or the Text Programs are subject to the dispute resolution provisions in our Terms of Service, including binding arbitration administered by the National Arbitration and Mediation (“NAM”) and any class action waiver and jury trial waiver set forth therein, to the fullest extent permitted by law.


19) Electronic Communications; E-SIGN Consent

You agree that these Text Terms and any other agreements, notices, disclosures, and communications we provide electronically (including via text message) satisfy any legal requirement that such communications be in writing, to the extent permitted by law.


20) Miscellaneous

  • Severability: If any provision is held unenforceable, the remainder will remain in effect.

  • No Waiver: Failure to enforce a provision is not a waiver of the right to enforce it later.

  • Assignment: We may assign our rights and obligations under these Text Terms in connection with a merger, acquisition, reorganization, or sale of assets.

  • Headings: Headings are for convenience and do not affect interpretation.

  • Survival: Sections intended by their nature to survive termination (including limitations of liability, indemnification, and dispute resolution) will survive.
